Business Gifting Privacy Notice

This Business Gifting Privacy Notice explains how Tradition Spice Company, a Colorado corporation ("Tradition," "we," "us," or "our"), collects, uses, discloses, retains, and protects personal information in connection with our business and corporate gifting program (the "Business Gifting Program"). It applies to information submitted through our Business Gifting landing page, inquiry form, quotes, order documents, recipient spreadsheets, customer communications, and fulfillment activities.

This Notice supplements Tradition's general Privacy Policy. The general Privacy Policy continues to apply to use of traditionspice.com, including cookies, analytics, advertising technologies, ordinary online purchases, accounts, and community features. If this Notice conflicts with the general Privacy Policy concerning recipient information or a Business Gifting order, this Notice controls for that information and order.

1. The People Covered by This Notice

This Notice covers:

  • Business contacts: people who submit an inquiry, request a quote, approve an order, provide payment or purchasing information, or communicate with us on behalf of a business, nonprofit, or other organization (the "Buyer").
  • Gift recipients: people whose information is supplied by a Buyer so we can personalize, ship, track, and support a gift.
  • Other authorized contacts: receiving contacts, event contacts, procurement personnel, and others involved in an order.

2. Our Role When a Buyer Supplies Recipient Information

The Buyer generally decides who will receive a gift, what recipient information to provide, and the business purpose for the gift. For that recipient information, Tradition ordinarily acts as a service provider or processor on the Buyer's instructions. Tradition may act as an independent business or controller for limited purposes that we determine, such as protecting our systems, preventing fraud, maintaining legally required records, resolving claims, and defending legal rights.

The Buyer is responsible for having a lawful basis and appropriate authority to provide recipient information to Tradition and for giving any notice or obtaining any permission required by law, contract, internal policy, or the Buyer's relationship with the recipient.

3. Information We Collect

Depending on the order, we may collect the following categories of information:

  • Business and contact information: name, job title, company, email address, telephone number, billing address, and communications.
  • Order and commercial information: requested products, quantities, occasion, budget, personalization choices, quotes, purchase orders, contracts, approval history, invoices, payment status, tax-exemption information, and order history.
  • Recipient fulfillment information: recipient name, recipient identifier, mailing address, optional email address or telephone number, gift message, personalization field, delivery instructions, shipment status, tracking number, delivery exception, and replacement history.
  • Payment information: payment method, billing details, transaction identifiers, and payment status. Payment card and bank information may be collected directly by our payment processor rather than stored by Tradition.
  • Artwork and content: logos, signatures, card text, inserts, trademarks, and other materials supplied for the order.
  • Technical information: IP address, browser and device information, form activity, timestamps, security logs, and information collected through cookies or similar technologies as described in our general Privacy Policy.
  • Support and claim information: correspondence, photographs of damage, carrier records, proof approvals, address corrections, and other information needed to resolve an issue.

Please do not provide sensitive personal information. Recipient files and gift messages should not contain Social Security numbers, government identification numbers, account credentials, payment-card data, health information, biometric information, precise geolocation, information about children, or details revealing race, ethnicity, religion, citizenship, sexual orientation, or other sensitive characteristics. If information is not needed to deliver the gift, please leave it out.

4. How We Collect Information

We collect information directly from business contacts, from the Buyer through an approved recipient spreadsheet or secure transfer method, from payment processors and service providers, from shipping carriers, and automatically when someone uses our website or inquiry form.

For individual-recipient orders, the Buyer should use the secure upload process provided by Tradition. Do not send completed recipient spreadsheets through ordinary email unless Tradition expressly provides an approved encrypted method.

5. How We Use Information

We use Business Gifting information to:

  • respond to inquiries and prepare recommendations, samples, quotes, and order documents;
  • verify pricing, capacity, payment, tax status, artwork, quantities, and approvals;
  • personalize, assemble, package, ship, track, and support gifts;
  • validate addresses and communicate address or delivery exceptions;
  • send transaction and shipment communications authorized by the Buyer;
  • process payments, maintain accounting records, and collect amounts due;
  • prevent fraud, maintain security, investigate misuse, and protect people, property, and legal rights;
  • manage replacements, refunds, carrier claims, disputes, and service recovery;
  • comply with law, tax, accounting, food-safety, recordkeeping, and legal-process obligations; and
  • analyze the performance and profitability of the Business Gifting Program using aggregated or appropriately limited information.

We do not use Buyer-supplied recipient information to add recipients to Tradition marketing lists, create advertising audiences, or send promotional messages unless the recipient separately and affirmatively asks to receive them.

6. How We Disclose Information

We may disclose information to the following categories of recipients when reasonably necessary:

  • Commerce and technology providers, such as Shopify and providers that host forms, files, email, security, or business systems;
  • Accounting and payment providers, such as QuickBooks and payment processors, for Buyer-level commercial records and payment processing;
  • Shipping and fulfillment providers, such as ShipStation, postal operators, carriers, insurers, printers, and approved vendors that help produce or deliver the order;
  • Professional advisers, including accountants, insurers, auditors, and legal counsel;
  • Government and legal recipients when disclosure is required by law, valid legal process, or reasonably necessary to protect rights, safety, or security; and
  • Transaction parties in connection with a proposed or completed financing, merger, acquisition, reorganization, or sale of business assets, subject to appropriate confidentiality protections.

We do not sell Buyer-supplied recipient information. We do not share Buyer-supplied recipient information for cross-context behavioral advertising or use it for targeted advertising.

7. Address Validation and Shipping Information

We may submit recipient addresses to shipping technology providers and carriers for validation, standardization, rating, label creation, delivery, tracking, and claims. Automated address tools may suggest a standardized or corrected address. A validation result does not guarantee delivery, and a suggested correction may not reflect the Buyer's intended address. We may ask the Buyer to confirm material changes before shipment.

Tracking information may be shared with the Buyer and, when authorized, with the recipient. A Buyer-facing report may identify recipients by recipient ID rather than display a full home address whenever practical.

8. Retention and Deletion

We retain information only as long as reasonably necessary for the purposes described in this Notice, including fulfillment, support, fraud prevention, accounting, tax, food-safety, contract, warranty, dispute, and legal obligations.

Tradition's operating standard is to delete active working copies and exported recipient spreadsheets within 90 days after final delivery, unless a longer period is reasonably necessary because of an unresolved delivery issue, replacement, claim, dispute, legal hold, signed agreement, or legal requirement. Transactional records retained in approved business systems may remain for a longer period under our record-retention schedule. Service providers may retain information according to their contracts, backup cycles, legal obligations, and documented retention practices.

We may retain deidentified or aggregated information that cannot reasonably be linked to an individual.

9. Security and Incident Response

We use reasonable administrative, technical, and physical safeguards appropriate to the nature of the information. These measures may include access limits, individual user accounts, secure transfer methods, controlled working files, vendor review, and deletion procedures. No method of transmission or storage is completely secure, and we cannot promise absolute security.

If we become aware of a security incident affecting recipient information, we will investigate, take reasonable containment measures, and notify the Buyer and affected individuals when required by applicable law or contract. Colorado law may require notice to affected Colorado residents and the Colorado Attorney General in certain circumstances.

10. Privacy Choices and Rights

Depending on where a person lives and whether an applicable privacy law covers Tradition and the information at issue, that person may have rights to confirm processing, access, correct, delete, or obtain a portable copy of personal information, and to opt out of certain sales, targeted advertising, sharing, or profiling. These rights are subject to verification, legal exceptions, and limitations.

Tradition does not sell Buyer-supplied recipient information or use it for targeted advertising. A recipient may ask us to correct or delete fulfillment information. Because the Buyer supplied the information and controls the gifting purpose, we may coordinate the request with the Buyer when appropriate and lawful. We will not disclose information to a requester until we reasonably verify identity and authority.

Where applicable, a person may use an authorized agent to submit a request. We may require proof of the agent's authority and may verify the request directly with the individual. We will not discriminate against a person for exercising an applicable privacy right.

Where applicable, we will respond within the period required by law. Under the Colorado Privacy Act, a covered controller generally must respond to a verified request within 45 days and may extend that period when permitted. If we deny a request that carries a legal right to appeal, the response will explain how to appeal. A Colorado resident may submit an appeal by replying with the subject line Privacy Appeal. If an appeal is denied, the resident may contact the Colorado Attorney General.

11. Cookies and the Business Gifting Landing Page

The Business Gifting landing page may use cookies, pixels, analytics, and similar technologies governed by Tradition's general Privacy Policy and available cookie controls. Information submitted in a Business Gifting inquiry is used to respond to the inquiry and administer the potential business relationship. It is not recipient fulfillment information unless and until a Buyer supplies it for an order.

12. Children's Information

The Business Gifting Program is offered to businesses and is not directed to children. Buyers must not provide information about children under 13. If we learn that such information was submitted, we may delete it and ask the Buyer to provide an appropriate adult recipient or delivery contact.

13. Changes to This Notice

We may update this Notice to reflect changes in our services, vendors, practices, or legal obligations. We will post the revised Notice with a new "Last updated" date. If a material change affects an accepted order, we will apply the version incorporated into that order unless the parties agree otherwise or law requires the change.
